Withdrawals exceeding the annual 10% free-withdrawal amount, or a full surrender during the withdrawal charge period, are subject to surrender charges and may also incur a Market Value Adjustment (MVA). Surrender charges decline each year and reach 0% after the ninth year, at which point the contract becomes fully liquid without surrender penalties. The MVA applies during the withdrawal charge period to withdrawals that are subject to withdrawal charges and may be positive or negative depending on interest rate conditions at the time of withdrawal (state variations may apply). Because ForeCare is commonly positioned as a long-term care repositioning strategy, clients should also understand that non-LTC withdrawals can reduce both contract value and the long-term care benefit available on a proportionate basis.

Traditional surrender-charge waiver riders (such as nursing home confinement or terminal illness waivers) are not presented as standard contract features in the provided materials. ForeCare’s primary protection feature is the long-term care benefit rider structure, which provides access to benefits once eligibility requirements are met.

After the first contract year, owners may withdraw up to 10% of the beginning-of-year contract value annually without surrender charges. Long-term care benefit claims reduce the amount available for free withdrawals. If a free withdrawal is taken and the owner fully surrenders the contract in the same contract year, the withdrawal charge is applied to both the amount previously taken as “free” and the remaining amount withdrawn. Withdrawals taken for reasons other than qualified long-term care benefits reduce the long-term care benefit available on a proportionate basis. Withdrawals of taxable amounts may be subject to ordinary income tax and, if taken prior to age 59½, may also be subject to a 10% federal tax penalty.

ForeCare® is a Single Premium Deferred Annuity (SPDA) funded with a one-time premium using non-qualified funds only. The contract credits tax-deferred interest at a fixed rate that is declared annually on each contract anniversary, with a guaranteed minimum interest rate that applies during and after the withdrawal charge period. Liquidity is governed by a 9-year withdrawal charge schedule, and a Market Value Adjustment (MVA) may apply to withdrawals that are subject to withdrawal charges during that period (state variations may apply). After the first contract year, the owner may generally withdraw up to 10% of the beginning-of-year contract value annually without surrender charges, but withdrawals taken for reasons other than qualified long-term care benefits reduce the available LTC benefit proportionately, which is an important planning consideration when positioning this product for care protection. This combined structure allows ForeCare to function as a conservative accumulation product with enhanced long-term care funding potential while preserving the possibility of a death benefit for any unused contract value.

ForeCare credits fixed interest declared annually on the contract anniversary. The contract includes a guaranteed minimum interest rate of 1% during the withdrawal charge period and 0.10% thereafter, ensuring the contract continues to credit at least the guaranteed minimum even if declared rates decrease over time. 

The surrender value equals the contract value minus any applicable surrender charges and any Market Value Adjustment (MVA) during the withdrawal charge period (state variations may apply). Because the MVA may be positive or negative, it can either increase or decrease the amount available upon surrender when a withdrawal is subject to charges.

At the same time, ForeCare maintains residual value: if long-term care is not needed or only partially used, any remaining contract value can still pass to beneficiaries as a death benefit, supporting the “use it for care if needed, otherwise leave what remains” planning objective.

After the surrender-charge period ends, the contract becomes fully penalty-free for withdrawals or full surrender.

The surrender value equals the account value minus any applicable surrender charges, but not less than the minimum nonforfeiture benefit required by Standard Nonforfeiture Law. SecureFore does not apply a Market Value Adjustment (MVA).
